BRISTOL, RHODE ISLAND — At 9:30 a.m. on Saturday, Feb. 23, the doors to Room 286 in the Roger Williams University School of Law building closed. Nine men sat in chairs, as several women, volunteer members of the Bristol Personnel Board, began instructing them on the test they were about to take.

One hundred questions. Two hours and 30 minutes. Testing their knowledge of police procedures; laws; concepts of supervision and management.

The nine test-takers included all of the top brass in the Bristol Police Department (excluding retiring Police Chief Col. Russell S. Serpa, whose job they were all seeking), as well as current and retired police veterans from Bristol and other communities.

When they finished the tests, the women collected the exams and sealed them in an envelope. Shortly after, the envelope was mailed to the University of Maryland’s testing center.

OAK BROOK, ILLINOIS - Judge William T. Hart in U.S. District Court in Chicago Friday dismissed four of the six counts in a lawsuit filed by former Oak Brook Police Sgt. Randy Mucha, leaving the door open for Mucha to pursue the charges elsewhere.

Mucha’s lawsuit, filed last September, maintains he was improperly discharged from the Oak Brook Police Department in July 2007. The grounds cited for his dismissal were engaging in conduct unbecoming an officer and violating several department rules.

One of the counts, alleging the firing was a violation of Mucha’s civil rights, was dismissed with prejudice, meaning he cannot pursue the charge.

Mucha said he plans to re-file in state court three other counts dismissed by the federal court. Those counts allege Mucha suffered invasion of privacy and defamation of character. He also asks the court to review the administrative decision by the Board of Fire and Police Commissioners to dismiss him.

OAK BROOK, ILLINOIS - Former Oak Brook Police Sgt. Randy Mucha and Assistant State’s Attorney Joe Ruggiero took the stand Wednesday as the civil complaint filed by Frances and Casey Gaik former village prosecutor Joan Mullins ground forward in the U.S. District Court of the Northern District of Illinois.

The Gaiks allege they were harassed by Mullins. The Gaiks’ attorney Steven Whitmer said in his opening remarks Monday that the case revolves around three factors: An investigation Mullins allegedly did of the Gaiks’ backgrounds, harassment via e-mails and an alleged malicious prosecution of Casey Gaik.

Ruggiero was called to testify about his relationship with Mullins and how it factored into the prosecution of a criminal battery charge against Casey Gaik in 2005. That case involved an incident outside of a village board meeting in March of that year, when Mullins alleged Casey Gaik battered her by grabbing both of her arms. A surveillance video of the hallway was recovered and shows Casey Gaik making physical contact with Mullins, but because of the camera angle, it is difficult to tell if Casey Gaik, at nearly 6 feet tall, touched or grabbed Mullins, who stands about 5-foot-3-inches.

Oak Brook Illinois Police Officer Stephen Peterson, Drew Peterson’s Son, Suspended For 8 Days After Showing Up For Grand Jury In Police Car And Uniform

OAK BROOK, IL - Drew Peterson’s son has been suspended from the Oak Brook Police Department for showing up at a grand jury appearance driving his police car and wearing his uniform.

Stephen Peterson was given an 8-day suspension Wednesday night for, according to his chief, casting the department in a bad light.

Peterson told the Oak Brook Police and Fire Commission he appeared before the grand jury four times, twice in uniform. He said he thought he had permission because he notified his superiors.

Peterson left the Oak Brook Village Hall following the commission’s ruling without comment.

Drew Peterson is a suspect in the October 28 disappearance of his fourth wife, Stacy. A Will County grand jury also is investigating the 2004 drowning of Kathleen Savio, his third wife, who was found dead in a dry bathtub.

The bare facts came out just days after Oak Brook’s insurance company agreed to pay $700,000 to settle claims by two officers that Mucha and other police officials had violated the officers’ First Amendment rights by harassing them for speaking out about the replacement of the village’s police chief. Former officer Donald Malec and current officer Martin Zelisko will split the $700,000.

Totally Disgraced And Fired Oak Brook Illinois Police Officer Randy Mucha At Center Of Another Large Settlement - Previously Responsible For $2,000,000 Payout After He Harassed Local Couple

OAK BROOK, ILLINOIS - Oak Brook’s insurance agency has made an offer to two village police officers to settle a lawsuit the officers filed against the western suburb and police personnel in 2006.

The Intergovernmental Risk Management Agency has offered officers Donald Malec and Martin Zelisko $700,000 plus attorney’s fees. The federal suit, filed in late 2006, alleges they were victims of retaliation by the village. The lawsuit also named Sgt. Tamie Shuey, Deputy Chief Stephen Larson and former Sgt. Randy Mucha as defendants. Mucha was fired in 2007 on several disciplinary reasons.

The alleged retaliation began in 2004 after the officers spoke out about issues within the department. Zelisko and Malec said retaliation included GPS devices being placed in their squad cars, suspensions and attempts to terminate their employment.

According to the offer, the $700,000 would be split between Malec and Zelisko. Attorney Kevin McJessy, representing the plaintiffs, said both men were pleased with the offer.

Harassing people isn’t all that new to Randy Mucha. He responsible for the $2,000,000 settlement awarded to an Oak Brook couple he harassed - after which his career in law enforcement headed straight downhill. He’s currently named in another federal lawsuit.

Hopefully nobody is stupid enough to ever again give this asshat a badge or a position where he has control or authority over normal people.

The moron references images obtained in 2006, which Mucha claims came from his pathetic little website. A quick look at the site in 2006, courtesy of the WayBackMachine Here, shows that content appeared there with absolutely no mention of copyright on the page, in the underlying HTML, displayed on the images, and there is no copyright information embedded within the files themselves.

Now, 2 years latter he’s trying to rewrite established copyright law and say the images are copyrighted… Others (Nutcase June Maxam/North Country Gazette) have tried and failed in similar attempts.

Eventually this idiot Mucha will realize that every time he takes a poke at Bad Cop News, he ends up on our front page for a month or two… Since Mucha’s obviously got so much free time on his hands, he should be dealing with the lawsuit against him, or reading up on copyright “Fair Use”, which would have applied here had the images been copyrighted and not distributed freely to the public on his site and others…

The insurer, the Intergovernmental Risk Management Agency, filed for a declaratory judgment in state court Dec. 13 claiming it does not have to cover Quinlan and Mucha in a suit filed by resident Terrence O’Malley last spring because the two acted beyond the “scope of their employment.”

But until a DuPage Circuit Court rules, IRMA will defend Quinlan and Mucha in the suit, which claims they “conspired to defame, slander and curb” O’Malley’s political criticism of Oak Brook officials beginning in 2004.

OAK BROOK, ILLINOIS - Former Oak Brook police Sgt. Randy Mucha has sued the village and police officials over his firing two months ago.

Mucha sued the village of Oak Brook, Police Chief Thomas Sheahan and the town’s Police and Fire Commission, which fired him July 23 for lying and unprofessional conduct.

In the suit filed in U.S. District Court in Chicago, Mucha accuses village officials of false arrest, defamation, malicious prosecution and invasion of privacy.

Sheahan wanted to fire Mucha regarding charges of insubordination and conduct unbecoming an officer. But at the police review panel’s first hearing in April, Mucha drew a 30-day suspension after being found guilty of some charges and cleared on others.

However, the board agreed with Sheahan’s new charge in July alleging Mucha lied at the spring hearing. Village attorney Mark Sterk called the latest suit “nonsense” and said the allegations prove why the panel fired Mucha.

He’s a liar,” Sterk said. “It just further demonstrates that this guy just has a problem with the truth.”

Mucha’s lawyer, Jerome Marconi, said the two hearings had a “predetermined result,” which was to fire Mucha. “There was no way Sheahan was going to allow him to return to work,” Marconi said.

Mucha was put on unpaid leave last September for doing what Sheahan considered an illegal background check on a resident, who later won a $2 million settlement in a federal lawsuit in which Mucha was one of the defendants.

But in July, the misdemeanor charge on the background check was dropped by the DuPage County state’s attorney’s office. Former Oak Brook police Sgt. Randy Mucha filed a lawsuit against the village and police officials over his firing two months ago.

“They keep hammering at it, and they keep going,” said Fran Gaik, who with Vescovi and Allison and a few others formed a citizens group that has kept a watchful eye on the village government.

Just last week, Allison, 72, set off howls at a board meeting by citing an unpaid legal bill as evidence of a “shadow government” at Village Hall.

The bill, totaling nearly $20,000 from Chicago law firm Laner Muchin, detailed conversations between village officials and the firm’s lawyers, which, Allison alleged, showed they were trying to get rid of Police Chief Tom Sheahan.

Allison said the first copy he received, through a Freedom of Information Act request, was unreadable because most of it was blacked out. However, another copy sent to him by Village President John Craig contained no blacked-out material.

Trustee Jeff Kennedy was the first to raise his voice, after resident Richard Allison spoke about an unpaid legal bill containing evidence Kennedy was part of a “shadow government” desiring to fire Police Chief Tom Sheahan.

Calling Allison’s claim an “outrageous fabrication,” Kennedy said he called the law firm, Lanier, Muchin, April 30 with a question about Sheahan’s contract.

Kennedy said Allison’s comments were “getting very close” to being libelous, “and I’m not going to sit here and take your crap.”

Legal fees and Sheahan played a major role in another squabble last year, when trustees battled over the chief’s investigation of former police officer Randy Mucha.

OAK BROOK, ILLINOIS – An Oak Brook Police officer sued multiple times for allegedly harassing residents was fired this week.

Randy Mucha, 43, said he now plans to work full time installing video and computer systems in police vehicles, just not for Oak Brook.

“I’m very disappointed,” Mucha said in an interview Tuesday. “We will be appealing to the circuit court.”

Mucha was recently suspended for 30 days without pay by the Oak Brook Police and Fire Commission, but Monday night the commission made it permanent.

The firing stems in part from testimony Mucha gave during a deposition in a federal lawsuit filed in 2005 by an Oak Brook couple who said Mucha repeatedly harassed them after they criticized his police department.

The police and fire commission found that Mucha lied during the lawsuit deposition last year about whether he was familiar with an e-mail user name sent from his computer to Fran and Casey Gaik’s home. Mucha initially said he was unfamiliar with the user name, Linda Lucinda.

Mucha’s attorney, Jerry Marconi, argued Monday night that Mucha didn’t lie but had simply forgotten he had used the pseudonym.

In April, Oak Brook village attorneys also asked Mucha about the pseudonym. He again said he didn’t recall the name. Marconi said Tuesday that it was again a case of a faulty memory.

On Tuesday, Marconi said his client won’t immediately file an appeal.

“We are going to have to wait to see what the written decision is,” Marconi said. “It’s confusing as to where [Mucha] was untruthful.”

Oak Brook agreed this year to pay $2 million to settle the Gaik’s harassment lawsuit.

The village admitted no wrongdoing.

He’s Like So Fired!

On Monday, Oak Brook’s Police and Fire Commission fired police Sgt. Randy Mucha, the veteran cop at the center of the village’s legal storms.

The two-man board found Mucha guilty of lying in previous testimony to the board.
The panel ruled in favor of Mucha in April regarding a raft of disciplinary charges filed by Police Chief Tom Sheahan. But the board agreed with Sheahan’s new charge alleging Mucha lied at the spring hearing and was guilty of conduct unbecoming of an officer.

The chief’s new charge hinged on Mucha’s Internet activities. At the earlier hearing, Mucha said he did not admit or deny using a female screen name while trying to find out who was investigating his own Internet use.

But Sheahan and his lawyer, Pat Luchansky, hammered the fact Mucha admitted he used the name in a federal court deposition months earlier. When Luchansky asked him about the deposition in April, Mucha said he was confused from all of the documentation in his various legal cases.

“I’m sure he’s lying,” Sheahan told the board Monday. Luchansky called Mucha’s recollection “completely unbelievable.”

The 20-year veteran cop said he was “very disappointed” and vowed to appeal the decision in DuPage County Circuit Court. Mucha has been on unpaid leave since last September, though the review board’s April decision cleared the way for him to return to work after a 30-day suspension.

Mucha was eligible to return to work in late May, but never received permission from the department. He said he did recently receive a month’s back pay for vacation time accrued in 2006.

Mucha also contended Sheahan, through Deputy Chief Steve Larson, offered him a chance to retire two weeks ago. Mucha rejected the deal, saying it would cast a perception of wrong-doing. [ And his firing won't? ]

Mucha’s attorney, Jerome Marconi, said Sheahan was just “dredging up the same old testimony” after Mucha had been cleared by the board in April.
“The chief is going to stop at nothing to make sure that Sgt. Mucha never returns to work,” Marconi said.

Marconi was successful in getting the newest board member, Fred Cappetta, to recuse himself from the case. Cappetta once represented a homeowners group that included O’Malley.

Cappetta said Monday he “respectfully disagreed” with Marconi’s motion but recused himself, “to avoid the appearance of impropriety.”

A 20-year veteran of the Oak Brook Police Department who has been embroiled in various legal controversies for more than two years was fired Monday by the Police Commission.

Sgt. Randy Mucha was found guilty of lying and conduct unbecoming an officer after 15 minutes of deliberation by commissioners John Baar and Edward Nielsen. The accusations involved testimony he gave at a commission hearing and in an amended deposition for a federal lawsuit.

Mucha said he planned to appeal the ruling.

“Very disappointed,” was all he said.

His attorney, Jerry Marconi, told the commissioners that finding Mucha guilty would have a chilling effect on police who might consider changing testimony they later realize was incorrect.

“If you do [change testimony], you’ll find yourself in the same position as Sgt. Mucha,” he said.

Newly appointed Commissioner Frederick Cappetta recused himself after Marconi complained that Cappetta represented an Oak Brook subdivision in a matter involving Police Chief Thomas Sheahan.

The testimony came in a case last year involving Oak Brook residents Frances and Casey Gaik, who filed a federal lawsuit in 2005 alleging that Mucha and other village representatives harassed them for their work in the Oak Brook Citizens for Better Government, a watchdog group. The Gaiks won a $2 million settlement last year with the village admitting no guilt.

Mucha testified in that case that he did not know Linda Lucinda. But his attorney later filed an amended deposition, saying Mucha used the screen name of Lucinda in an e-mail exchange.

During the commission hearing, Mucha said he signed the amended deposition without reading it, but Sheahan accused him of lying to cover up inconsistencies.

Mucha was named in another federal lawsuit filed in late September by two Oak Brook police officers who alleged he and others were attempting to discredit them for talking to trustees and residents critical of the Police Department. A third lawsuit, filed in March by another village resident, alleged abuses of power similar to those in the Gaiks’ case.

The department sought to fire Mucha, accusing him of official misconduct, even as misdemeanor charges were pending against him for allegedly using a police database to conduct an illegal background search of Frances Gaik. Those charges were dropped by the DuPage County state’s attorney earlier this month, just before his trial was scheduled to start.

Mucha went on paid leave in June 2006; his salary was stopped a few months later. After months of disciplinary hearings, the commission decided to suspend him for 30 days without pay. He could have returned to work at the end of May, but did not.

Oak Brook Illinois Police Officer Randy Mucha, Subject Of Multi-Million Dollar Lawsuits And Settlement, Fired After Panel Determines He Lied

OAK BROOK, ILLINOIS – An Oak Brook Police officer sued multiple times for allegedly harassing residents was fired this week.

Randy Mucha, 43, said he now plans to work full time installing video and computer systems in police vehicles, just not for Oak Brook.

“I’m very disappointed,” Mucha said in an interview Tuesday. “We will be appealing to the circuit court.”

Mucha was recently suspended for 30 days without pay by the Oak Brook Police and Fire Commission, but Monday night the commission made it permanent.

The firing stems in part from testimony Mucha gave during a deposition in a federal lawsuit filed in 2005 by an Oak Brook couple who said Mucha repeatedly harassed them after they criticized his police department.

The police and fire commission found that Mucha lied during the lawsuit deposition last year about whether he was familiar with an e-mail user name sent from his computer to Fran and Casey Gaik’s home. Mucha initially said he was unfamiliar with the user name, Linda Lucinda.

Chief Trying To Fire Oak Brook Illinois Bad Cop Randy Mucha For Lying During Deposition, Asks That He Be Suspended Again - Officer Subject Of Prior $2 Million Settlement After Harassing Residents, Named In Currrent Lawsuit

OAK BROOK, ILLINOIS – Misdemeanor criminal charges against an Oak Brook police officer accused of using a police database to conduct an illegal background search about a resident were dropped Thursday.

Sgt. Randy Mucha was charged in April 2006 with violation of the uniform conviction act, and a trial was set to begin Thursday.

Richard Kayne, Mucha’s attorney, said Thursday that Mucha was investigating village resident Casey Gaik, who Mucha thought had obtained another police officer’s unlisted telephone number.

“This use of looking at police files to check to see if another officer has anything to be concerned about is proper use of police authority,” Kayne said.

DuPage County State’s Atty. Joseph Birkett said Thursday he had previously told Oak Brook Police Chief Thomas Sheahan that the evidence “no longer supports the charge.”

“Every two weeks I still get my pay stub that says zero,” said the suspended Oak Brook cop Tuesday.

The reason Mucha, a 19-year veteran, gets paychecks worth nothing is because of his recent conduct with the Oak Brook Police Department. He was suspended without pay last August when he was arrested on a misdemeanor charge.

Police Chief Thomas Sheahan wanted to fire Mucha, but a police review board in late April chose instead to suspend the 43-year-old cop for 30 days and let him go back to work.

Mucha said his suspension ended two weeks ago, but he is still waiting for word from the village and Sheahan.

Disgraced And Suspended Oak Brook Illinois Police Officer Randy Mucha, Guilty Of 9 Of 15 Departmental Charges, Subject Of $2 Million Settlement, Subject Of $1 Million Lawsuit, Returns To Department Without Back Pay

OAK BROOK, ILLINOIS – Also, suspended Oak Brook police Sgt. Randy Mucha can return to work next week but will not collect back wages, officials said.

The Board of Police and Fire Commissioners ordered Mucha to serve a 30-day unpaid suspension beginning April 27. Mucha has been on leave from the department since June, though the commission ruled to stop his salary in September.

Police Chief Thomas Sheahan on Tuesday said Mucha’s suspension ends Monday but he will probably start back Tuesday.

Mucha must undergo several days of training before he is assigned to regular duties, Sheahan said. Mucha could not be reached for comment.

At a meeting Monday, Commission Chairman John Baar said Mucha will not be paid lost wages because he was found guilty of nine of 15 charges. Sheahan alleged Mucha violated department policies, including insubordination and inappropriate conduct. But the commission found Mucha not guilty of charges that warranted termination.

Accusations Continue In Oak Brook Illinois - Nothing Yet About Efforts To Rein In Bad Cop Randy Mucha In Order To Keep Insurance Company From Canceling Liability Coverage

OAK BROOK, ILLINOIS ? Everything old is new again at one desk in Oak Brook Village Hall this week.

The former acting village manager, Jeff Moline, is now back on the job as the town?s top, but temporary, administrator, following a swirl of votes at a special Village Board meeting Tuesday.

Trustees hired a search firm in March to look for a permanent successor to former village manager Rick Boehm and will get the firm?s list of applicants Tuesday.

Moline said he will not apply for the permanent manager?s job. When new Village President John Craig appointed Patricia Horne, a campaign associate, to be the acting manager, Moline returned to his normal duties as assistant village manager.

Five village trustees filed litigation Monday in DuPage County Circuit Court to block Horne from taking office.

OAK BROOK, ILLINOIS – Oak Brook’s acting Village Manager Pat Horne said last week that one of her greatest concerns were lawsuits against village officials.

Horne had one more suit to worry about Monday — filed against her personally by five village trustees. Trustee Jeff Kennedy said the suit, filed in DuPage Circuit Court, seeks to remove Horne because she was in village offices last week going through files, though her appointment took effect Monday.

“In effect you had an unauthorized civilian person going through files,” Kennedy said. “We felt we had a fiduciary obligation in the best interests of the village to take this action. We didn’t think we had any choice.”

Village President John Craig appointed Horne but, according to Kennedy, should have obtained trustee approval of the appointment.

Horne on Friday acknowledged that her new position would not officially take effect until Monday.
