Elgin Illinois Police Officer, Aiming For Dog, Shoots Another Officer In The Leg

ELGIN, ILLINOIS – An Elgin police officer inadvertently shot another police officer in the leg Thursday when a pit bull charged them as they tried to serve a warrant, police said.

Elgin police Officer Ken Ericson, a 9-year veteran with the Elgin Police Department, was treated at Sherman Hospital in Elgin and released Thursday evening, police said.

No one was home about 11:50 a.m. at an apartment at 1145 Fairwood Drive when a pit bull charged the officers on an outside balcony area, police said. A police officer shot the dog, which died at the scene.

The officers intended to serve a warrant at the address for a person wanted for failure to appear in Kane County Court, police said.

The shooting remains under investigation by the Elgin Police Department.

Citing concerns over the girl?s home environment and her already lengthy juvenile record, Judge Michael Chmiel denied the girl?s request for home detention. Instead Chmiel ordered her held in the Kane County Juvenile Justice Center while the case is pending.

The girl?s record, Chmiel said, features 13 contacts with police, including an arrest for marijuana possession in August. McHenry County court records show that within the past year the girl also has been charged for driving without a license, consumption of alcohol by a minor, possession of tobacco by a minor, trespassing and three curfew violations.

Just a month ago, his dream of becoming a marine was nearly shattered when he was charged with disorderly conduct for alleged threats he made in a school essay.

A McHenry County judge showed him no mercy in return.

Quilici, 35, was sentenced to two years in prison after testifying today he believes he acted properly the night in 2005 when authorities say he and two colleagues beat a handcuffed man so viciously he needed a plate inserted in his face to repair the damage.

?You are not above the law as you thought you were because you carried a gun and a badge,? Judge Sharon Prather told Quilici before issuing the two-year sentence. ?No law enforcement officer should ever act as you acted.?

Quilici, of Oswego, was a police officer in the northern McHenry County town of Richmond on Feb. 20, 2005, when he and two former colleagues in a neighboring community went out after work to KC?s Cabin in Fox Lake.

In court papers filed Monday, the lawyer for Jessica Thelen says they may call Nichole Owens, criminal division chief for the McHenry County state?s attorney?s office and the person heading the prosecution of the case, as a defense witness.

Thelen, 30, of Bristol, faces charges of aggravated battery, mob action and obstructing justice in connection with a February 2005 incident outside KC?s Cabin in Fox Lake that left a man with severe facial fractures.

Authorities claim Thelen joined three men ? two of them active-duty police officers, another a former cop ? in punching and kicking a handcuffed McHenry County man with whom the officers had argued inside the bar.

Ron_DelelioCARY, ILLINOIS ? A Cary-Grove High School senior was being tutored off-campus Wednesday following his arrest for writing what officials called an alarming essay that allegedly referred to a shooting but did not contain any specific threats.

Allen W. Lee, 18, has been charged with disorderly conduct stemming from an essay that was part of a “free writing” assignment in a creative writing class.

The teen was charged because his teacher became alarmed by the “violence” he described, Cary Police Chief Ron Delelio said. The essay contained no specific threats but was “disturbing and inappropriate,” he said.

The paper allegedly made a vague reference to a fictional school shooting in McHenry County but didn’t specify a school or district, a law enforcement source said.

“We think they have been too harsh,” Lee’s father, Albert Lee, said Wednesday. He declined to comment further, except to say “every story has two sides.”

CARY, ILLINOIS ? High school senior Allen Lee sat down with his creative writing class on Monday and penned an essay that so disturbed his teacher, school administrators and police that he was charged with disorderly conduct.

“I understand what happened recently at Virginia Tech,” said the teen’s father, Albert Lee, referring to last week’s massacre of 32 students by gunman Seung-Hui Cho. “I understand the situation.”

But he added: “I don’t see how somebody can get charged by writing in their homework. The teacher asked them to express themselves, and he followed instructions.”

Allen Lee, an 18-year-old straight-A student at Cary-Grove High School, was arrested Tuesday near his home and charged with disorderly conduct for an essay police described as violently disturbing but not directed toward any specific person or location.

The youth’s father said his son was not suspended or expelled but was forced to attend classes elsewhere for now.

MARENGO, ILLINOIS – Two brothers on Monday admitted they lied about a Marengo police officer’s use of excessive force, in exchange for dismissal of felony charges in a plea deal, McHenry County’s top prosecutor said.

Brian Gaughan Jr., 23, of the 3700 block of Standish Road, Marengo, and Kevin Gaughan, 20, of the 100 block of John Street, DeKalb, pleaded guilty to attempted disorderly conduct, a misdemeanor, for lying about Brian Gaughan’s head being rammed into a wall during an October 2004 arrest at a Marengo festival, State’s Atty. Lou Bianchi said.

The brothers were sentenced to a year of conditional release, records show. The Gaughans faced up to 5 years in prison if they had been convicted of battering a police officer and filing a false police report, both felonies, Bianchi said.

The brothers have a federal civil suit pending against Marengo police and former Officer Scott Crawford, Bianchi said.

WOODSTOCK, ILLINOIS ? A Woodstock police officer was found guilty of misconduct at a hearing Friday and suspended from duty for seven calendar days without pay.

Woodstock Police Chief Robert Lowen alleged that patrol officer Sandra Valle acted inappropriately when she tried to negotiate with a McHenry County prosecutor on a personal matter while in police uniform, the complaint stated.

Lowen had recommended suspending Valle for 30 days.

?I thought it was a serious enough offense to take to the commission, and the commission did what they felt necessary,? Lowen said.

On Jan. 5, Valle?s 16-year-old son appeared in court after being cited for littering and disorderly conduct by Woodstock High School?s school resource officer, Joshua Fourdyce.

Fired McHenry County Illinois Prosecutor Troy Wise Admits To Drunk Driving

MCHENRY COUNTY, ILLINOIS – A fired McHenry County prosecutor pleaded guilty Friday to a drunken driving charge stemming from a crash last month in which his car hit a telephone pole so hard it snapped it off at its base.

Troy Wise, 32, of Woodstock was placed on one year of court supervision and ordered to pay a $950 fine under a plea bargain to a misdemeanor count of driving under the influence filed in connection with the Feb. 15 crash. If he serves the year of supervision without incident, a DUI conviction will not enter his record.

He also was ordered to make a $150 donation to the Alliance Against Intoxicated Motorists and attend a victim-impact panel in which family members of those killed in crashes involving intoxicated drivers speak to DUI offenders. A second drunken-driving charge and an improper lane usage ticket were dismissed as part of the plea deal.

McHenry County Illinois Deputy Sheriff Zane Seipler Won’t Be Charged After Killing Suicidal Man With Beanbag Shotgun

WOODSTOCK, ILLINOIS - No criminal charges will be filed against a McHenry County sheriff’s deputy who fatally wounded a northern Illinois man last fall with a shotgun loaded with beanbags, officials said Thursday.

An investigation by the Illinois State Police found that Deputy Zane Seipler’s shooting of David Maxson, 43, in September was justified, according to a news release from the McHenry County state’s attorney.

County prosecutors agreed with the findings, saying that Seipler’s actions were “necessary to prevent the possibility of death or great bodily harm” to the officer or others.

Maxson’s fiancee had called authorities to the couple’s home because he was threatening suicide, officials said.

When police arrived, Maxson lunged at officers with several knives, prompting Seipler to fire three shots at him from the shotgun loaded with beanbags, according to the state’s attorney’s office.

Marengo Illinois Police Officer Courtney Miller Enters Not Guilty Plea After Her Arrest In Winnebago County For Drunk Driving

ROCKFORD, ILLINOIS ? A Marengo police officer has pleaded not guilty to charges of driving under the influence of alcohol and will next appear in court March 13.

Courtney Miller, 32, entered her plea Wednesday before Winnebago County Judge Richard Lucas, according to the Winnebago County state?s attorney?s office.

Miller, a Marengo police officer since December 2005, was stopped by the Illinois State Police at 3:44 a.m. Feb. 6 in Rockford at Main Street (Route 2) and Auburn Street.

She was off-duty at the time, and city property was not involved.

Miller has been on paid administrative leave from the department since Feb. 7, pending the results of an investigation.

She was the third McHenry County law-enforcement official to be charged with drunken driving in a month.

Both of the other law-enforcement officials to be charged have since lost their jobs. Troy Wise, a McHenry County prosecutor, was fired Feb. 15, a day after he crashed his car into a utility pole.

Marengo Illinois Police Officer Courtney Miller Arrested, Suspended, Charged With DUI - Third McHenry County Law Enforcement Official Charged With Drunk Driving In The Last Month

MARENGO, ILLINOIS ? A Marengo police officer has become the third McHenry County law-enforcement official to be charged with drunken driving in the past month.

Patrol officer Courtney Miller, 32, is scheduled to appear Wednesday afternoon in Winnebago County Circuit Court.

She was stopped by the Illinois State Police at 3:44 a.m. Feb. 6 in Rockford at Main Street (Route 2) and Auburn Street.

No additional information about the arrest was available from the state police.

Miller did not respond to a request for comment through her attorneys, Sreenan & Cain of Rockford.

Marengo Police Chief Les Kottke confirmed Thursday that Miller was put on paid administrative leave Feb. 7 pending an investigation. He said the arrest occurred while the officer was off-duty and did not involve any city property.

Miller has been with the department since December 2005.

McHenry County Illinois Assistant State’s Attorney Troy Wise Fired After Drunken Crash Into Utility Pole East Of Marengo

WOODSTOCK, ILLINOIS - An assistant McHenry County state?s attorney was fired Thursday, a day after he crashed his car into a utility pole and was charged with driving under the influence of alcohol.

Troy Wise, 42, of Woodstock, was released from the McHenry County Jail on Thursday after posting $100 and his driver?s license for bail. He is scheduled to appear in court March 2.

McHenry County sheriff?s police said Wise crashed his 2006 Pontiac G6 into a utility pole along on Route 176, just east of Marengo about 11 p.m. Wednesday.

Wise was the only passenger in the car and was taken to Woodstock Memorial Hospital, where he was treated for minor injuries, police said.

At the hospital, he refused to submit to a blood draw, McHenry County Sheriff Keith Nygren said. Wise, however, did agree to a Breathalyzer test about four hours after the accident at the sheriff?s department, in which he blew above the legal limit of .08, Nygren said. The sheriff declined to release the exact test results.

Wonder Lake Illinois Firefighter Mark S. Nowosatko Charged With Child Molestation

WOODSTOCK, ILLINOIS - A Wonder Lake firefighter has been charged with sexually abusing a 14-year-old girl who police said he’s had a relationship with since June 2006.

A judge on Thursday set bond for Mark S. Nowosatko, 34, of 7404 Algonquin Road in Wonder Lake, at $75,000 for two counts of aggravated criminal sexual abuse. He was in custody at the McHenry County Jail on Thursday afternoon.

If convicted, Nowosatko could face up to seven years in prison.

Police said they believe the relationship developed after Nowosatko met the girl at a party. Since then, the couple started dating and having a sexual relationship, police said.

The victim and defendant told police the relationship was consensual, said Lt. Don Carlson of the McHenry County Sheriff’s Department.

Nowostako, an on-call firefighter for the Wonder Lake Fire Protection District, was still on his probationary period and has been placed on unpaid-leave, Chief John Rice said.

Former College Of Lake County Illinois Police Officer Marc C. Carder Arrested On New, More Serious, Child Molestation Charges

COLLEGE OF LAKE COUNTY, ILLINOIS – A former College of Lake County police officer was back behind bars Thursday facing new, and more serious, charges alleging he carried on a sexual relationship with an underage girl.

McHenry County sheriff’s police arrested Marc C. Carder, 46, Thursday morning after accusations surfaced that he had been involved sexually with the teenage girl dating back to 2002, when she was just 12.

The arrest comes a little less than three weeks since sheriff’s police first arrested Carder on allegations stemming from a 2006 encounter with the girl.

The Island Lake man now faces a charge of predatory criminal sexual assault and two more counts of aggravated criminal sexual abuse. The assault charge, a Class X felony, is punishable by a minimum six and maximum 30 years in prison.

Wife Of College Of Lake County Police Officer Marc W. Carder, Who Is Charged With Child Molestation, Charged With Harassing Victim’s Family

MCHENRY COUNTY, ILLINOIS – The wife of a College of Lake County campus police officer charged with molesting a 15-year-old girl was arrested herself Friday, accused of harassing the teen’s family.

Geraldine F. Carder, 45, of Island Lake faces one count of harassment of a witness alleging she contacted the girl’s family through the mail asking them if they could meet to resolve the charges against her husband outside the criminal justice system.

“It wasn’t threatening,” McHenry County sheriff’s Sgt. Michael Cisner said. “It was a letter asking if they wanted to sit down and discuss the situation.”

The letter, authorities said, caused emotional distress and mental anguish to the girl’s family and violated state law regarding contact with victims and witnesses in a criminal case.

Carder was taken into custody Friday and later freed on $1,000 bond. The charge against her is a Class 2 felony punishable by a maximum three to seven years in prison.

McHenry County Deputy Sheriff Donald R. Anderson Arrested, Charged With DUI And Reckless Driving After Drunken Crash Into Tree With Patrol Car

CRYSTAL LAKE, ILLINOIS – A McHenry County Sheriff’s deputy has been charged with driving under the influence after he allegedly lost control of a squad car and crashed into a tree about 5:54 a.m. Jan. 20.

Crystal Lake police charged 24-year-old Donald R. Anderson, of Huntley, with driving under the influence and reckless driving, according to a press release. Anderson was not on duty at the time of the crash.

Preliminary investigation shows that Anderson was driving east on Buckingham Drive about 300 feet east of McHenry Avenue when he crossed into the westbound lane and hit a tree on the north side of the road.

Anderson was examined at the scene but was not hospitalized, according to the press release. He surrendered to Crystal Lake Police on Thursday and was released on bond pending a Feb. 13 court appearance, police said.

MCHENRY COUNTY, ILLINOIS – A high-ranking member of the McHenry County sheriff’s department accused last year of exposing himself to a neighbor formally resigned his post this month, Sheriff Keith Nygren confirmed Thursday.

Former Lt. Jeffrey Stafford made the decision to resign this month while awaiting a hearing before the sheriff’s Merit Commission that could have determined whether he could return to the force or would lose his job as a result of his June 30 arrest.

Stafford, 48, of McHenry, pleaded no contest in August to a misdemeanor disorderly conduct charge stemming from allegations he exposed himself to a female neighbor twice in June while standing next to an unobstructed window in his home. Authorities said the incidents were captured on videotape.

After the arrest McHenry County Sheriff Keith Nygren placed Stafford on administrative leave, where he remained until tendering his resignation this month.

Carder is charged with aggravated criminal sexual abuse, a crime punishable by up to seven years in prison.

The two had a sexual relationship for about a year, said Lt. Don Carlson of the McHenry County Sheriff?s Office.

?This was a consensual relationship between the victim and the offender,? Carlson said. ?But she is not at an age that she could give consent.?

Their relationship was exposed, police said, when the victim?s father found pornographic photos of his daughter and Carder on a home computer.

MCHENRY COUNTY, ILLINOIS – Calling Lawrence Preston’s fatal shooting of a neighbor’s dog an aberration in an otherwise law-abiding life, a McHenry County judge today rejected calls to sentence the former Huntley police officer to jail.

Instead Judge Joseph Condon placed Preston, 51, on conditional discharge for two years, fined him $2,000 and ordered him to perform 50 hours of community service for a shooting authorities blamed on a longstanding neighborhood feud.

“This incident is an aberration in the defendant’s otherwise acceptable behavior,” Condon said. “Incarceration or probation would not be appropriate in this case.”

A jury convicted Preston in October of a felony charge of aggravated cruelty to an animal stemming from the May 5, 2005, shooting of his neighbor’s dog, a 96-pound Anatolian shepherd name Mourgio, in the back yard of his rural Harvard home.

Former Huntley Illinois Police Officer Lawrence Preston Found Guilty Of Shooting His Neighbor’s Dog After Years Of Bad Blood Between Him And Neighbor

McHENRY COUNTY, ILLINOIS – Lawrence Preston called it self-defense when he shot his neighbor’s dog last year, but a McHenry County jury this afternoon called it a crime.

Jurors deliberated 2¨ hours today before finding the former Huntley police officer guilty of aggravated cruelty to an animal in connection with the fatal shooting that authorities say was the result of a longstanding feud between Preston and the dog’s owner.

Preston, who was in training for the Lake County Sheriff’s Department’s Marine Unit at the time of the shooting, now faces up to three years in prison, but also probation, when sentenced Dec. 22 for the felony conviction.

He declined comment on the verdict, but his attorneys called the decision “very disappointing” and said they would weigh their appeal options.

“The issue was self-defense, but unfortunately the jury didn’t see it that way,” defense lawyer David Rechenberg said.

MARENGO, ILLINOIS ? State investigators did not threaten, intimidate or abuse a Marengo teen into making a false confession against himself and his older brother, a McHenry County judge said Friday in a much-anticipated ruling that hands a huge victory to McHenry County prosecutors and state police.

Denying a defense request to throw out the confession, Judge Joseph Condon ruled that prosecutors could present evidence that Kevin Gaughan, now 20, told authorities he made up claims he saw a Marengo police officer shove his older brother, Brian Gaughan, head first into a wall in 2004.

Condon?s four-page written decision also rejects allegations a state police investigator punched another suspect in Gaughan?s presence to intimidate the teenager. A video recording showing the younger Gaughan?s interrogation does not show that, the judge said.

MARENGO, ILLINOIS - A pair of brothers at the center of a long-running police abuse controversy in McHenry County are now suing two Illinois State Police investigators, claiming they conspired to bring false charges against them.

The new claims, filed Monday in U.S. District Court, are part of a larger multimillion-dollar civil rights suit brothers Brian and Kevin Gaughan and four others filed last year against the city of Marengo, two of its former police officers and its former police chief.

The new allegations claim State Police Special Agent William Kroncke and Investigator Virgil Schroeder physically and verbally abused Kevin Gaughan, 20, during a November 2004 interrogation.

Illinois_state_policeMARENGO, ILLINOIS – Two Illinois State Police investigators resorted to physical and mental brutality as they tried to persuade a man to recant accusations of excessive brutality that he and his brother had made against Marengo police, a revised federal lawsuit alleges.

The revision to the civil-rights lawsuit was filed Monday in U.S. District Court in Chicago, nearly two years after brothers Brian and Kevin Gaughan alleged that former Marengo police officer Scott Crawford used excessive force during an arrest for trespassing on Oct. 8, 2004.

The amended complaint adds as defendants state police Special Agents William Kroncke and Virgil Schroeder, who were assigned to investigate the allegations of excessive force.

McHENRY COUNTY, ILLINOIS ? A Wonder Lake man whom police shot in the head with a beanbag shotgun after he allegedly lunged at them with a knife died late Wednesday night, authorities said Thursday.

David K. Maxson, 43, of the 4800 block of West Wonder Lake Drive, died at 11:25 p.m. in the intensive-care unit at Northern Illinois Medical Center in McHenry, according to police and his fiance, Patsy Ercoli.

Police say they shot Maxson in the arm, chest and head Saturday with three beanbags after Ercoli called them to the home they shared at about 4 p.m. because Maxson was suicidal.

Inside, Maxson confronted six officers with a knife, according to McHenry County sheriff’s police.

“When Dave was brought out of the house he was already in a coma and paralyzed,” Ercoli said Thursday. “And he never came out of the coma.”
