Lorain Ohio Po9lice Officer David Kusnir Illegally Bars City Councilman Dennis Flores From Neighborhood Watch Meeting

LORAIN, OHIO — When City Councilman Dennis Flores showed up to a neighborhood watch meeting Thursday night, he was firmly asked to leave.

Several watch captains met at City Hall to plan a crime-prevention picnic in August. Flores said he is a watch captain, too, but when he tried to get into the meeting, he was stopped by Lorain police officer David Kusznir.

“He said he didn’t want me there,” Flores said. “I was worried that if I went in there, they would call the police and have me escorted off the property.”

Flores, D-2nd Ward, was charged May 23 with DUI and trying to solicit a prostitute. He was one of six men arrested during a citywide sting.

A pretrial has been set in Lorain Municipal Court for Aug. 22, but in the meantime, Flores said police who run the city’s neighborhood watch aren’t giving him any breaks.

ELYRIA, OHIO - An Elyria police training exercise surprised a group of people attending a childrens production at Lorain County Community College Friday night, as officers went through Stocker Center with guns drawn just before the play began.

The drill was part of an ongoing series of training exercises that Elyria police are performing at the college. An LCCC official said yesterday that Stocker Center was not a building that was supposed to be included in the exercise.

Allegations have also surfaced that a gun was pointed at Lorain County Children’s Pioneer Theatre Technical Director J.R. Simons, but he declined to comment on them yesterday prior the second performance of the play. Simons is also the acting president and treasurer of the board of drustees for the theater company.

The group was putting on a production of “Willy Wonka and the Chocolate Factory.”

Lorain Ohio Police Officer Shot With BB Gun While Jogging

ELYRIA, OHIO — Someone shot a Lorain police officer with a BB or pellet gun while he was jogging Wednesday afternoon along Lowell Street, according to Elyria police.

The officer was jogging Wednesday around 4 p.m. when he believes someone shot a pellet of BB gun at him on Lowell Street near Murray Ridge Road. The officer told Elyria police he saw three white males, in their teens or 20s, in a a black Dodge pickup truck in the area at the time.

The Lorain officer had a 1-inch diameter red area on his back from the incident, the report said. He said the projectile broke his skin, but he did not sustain any serious injuries.

”It broke the skin and (drew) blood a little bit,” he said.

The office believed it was a random act and he was not targeted. Elyria police checked the area but did not find the truck.

Veteran Lorain Ohio Police Officer Sgt. James Wolford Under Investigation, But Remains On Duty Despite 4 Separate Complaints Against Him

LORAIN, OHIO — Police are investigating four separate complaints against police Sgt. James Wolford, who remains on active duty.

But police officials won’t say what accusations have been leveled against the veteran officer, who has been on the hot seat before.

Lt. Jim Rohner, who is heading up the investigation into Wolford, said the complaints were confidential.

Police Chief Cel Rivera — who deferred comment on the investigation to Rohner — is aware of the investigation and decided to keep Wolford on the road, Rohner said.

One of the complaints dates back to fall of last year, Rohner said, but he would not elaborate on why it’s only now being investigated. The other three incidents took place within the past few months, Rohner said.

Rohner also is handling the investigation into veteran patrolman Jack Brown, who is accused of using racial slurs and spitting on his niece during a drunken Fourth of July incident. Brown also remains on duty.

LORAIN, OHIO - Veteran Lorain police officer Jack Brown is the subject of an internal investigation after allegations of drunken and menacing behavior surfaced against him.

Police were called to 120 Waverly Place around 10 p.m. Friday after Brown, who recently returned to the force after being suspended for showing up to work drunk, allegedly directed racial slurs to one of the hosts and his stepdaughter.

Susan James said she was throwing her 15-year-old daughter a birthday party when her sister showed up with an intoxicated Brown, who is her fiancé. The couple was with her niece and Brown’s two children. James wanted Brown to leave immediately, but her boyfriend convinced her to give him a chance.

It wasn’t long until Brown was allegedly stumbling around and had passed out briefly on a couch, James said. She said no alcohol was given to him at her residence.

Suspended Lorain Ohio Police Officers Jesus “Jesse” Sanchez And Stanley Marrero Back On The Payroll

LORAIN, OHIO - Two indicted Lorain police officers will be back on city payroll beginning today.

Jesus Sanchez and Stanley Marrero have been on unpaid administrative leave since May 1. However, the Ohio law limits the amount of time the two men can be on unpaid administrative leave to two months, according to Safety Director Phil Dore.

”We would have preferred to keep them on unpaid leave but are restricted by law to two months,” he said.

Dore said he would meet with police Chief Cel Rivera and Law Director Mark Provenza to determine what the two men could do rather than stay on paid leave.

”Obviously, it’s, in our opinion, in the best interest of the community that if we’re paying these people, we should identify a task that needs to be completed and have them work on it rather than give them a free ride at home,” Dore said.

Drunk Driving Charges Conveniently Disappear For Lorain Ohio City Service Director Robert Gilchrist

LORAIN, OHIO — When city Service Director Robert Gilchrist was hired, he had a pending drunken driving charge.

Last month, Gilchrist pleaded no contest to a reduced charge of reckless operation. He was found guilty and received a suspended jail sentence.

Gilchrist said he wasn’t drinking when his 1995 Mercedes went off the road and struck a hill around 1:30 a.m. Nov. 14 in Toledo.

“I was coming home from work and fell asleep at the wheel,” he said.

Despite a summary of the incident on the ticket he was issued in the crash that says Gilchrist performed poorly on field sobriety tests, he insists he did fine. He also said he didn’t refuse a breath test when he was booked into the Lucas County Jail, as the ticket said he had.

Gilchrist said he asked for his attorney and the corrections officer administering the test didn’t push the issue of the breath test.

Lorain Ohio Makes Up New Rule To Suspend Health Insurance For Suspended Police Officers After One Complains About Not Receiving Other Benefits

LORAIN, OHIO — Suspended Lorain police Officer Jesus Sanchez’s complaint that he wasn’t receiving his uniform allowance this year has cost him and another suspended officer their health insurance for the next month.

After Sanchez made his request for the $870 per year clothing allowance, Lorain Safety Director Phil

Dore said he asked the city’s Law Department to review whether the city had to pay out the cash.

The legal opinion said the city not only didn’t have to pick up Sanchez’s clothing bill while he was suspended without pay, it also wasn’t obligated to pay for insurance and other benefits, Dore said Friday.

Dore said Sanchez and Officer Stanley Marrero, who also is suspended without pay through the end of June, aren’t the only ones who will have to deal with the new rule, which goes into effect Sunday.

Document From Inside Lorain Ohio Police Department Surfaces - Some History On Nutcase Union President/Police Officer Corey Earl - A Ticking Time Bomb With Homicidal And Suicidal Issues

Earl, a 20-year veteran officer, was in Cleveland to attend the Kenny Chesney concert when he suddenly collapsed outside the stadium, Rivera said. He never made it to the concert.

Luckily, several people were around and called for an ambulance, Rivera said. Earl was taken to Lakewood Hospital and later admitted to the Neuro Integrated Intensive Care Unit.

Patient information at Lakewood Hospital would not disclose Earl’s condition, but said he was in fact in the NICU.

Rivera said he was notified Saturday about the incident and has visited him a couple times. He was not, however, able to speak with him. Rivera would not elaborate on his condition only to say “he’s going to be out for awhile.”

“We haven’t gotten any confirmation yet that it was a stroke,” he said, but added that initial reports point to that.

Earl’s family did not wish to make any statement.

“His fellow officers are real concerned,” Rivera said. “Several have already went to visit him. We are all hoping and praying for the best.”

Lorain Ohio Police Chief Cel Rivera Disciplines Dispatcher For Being Sick, Another For Delay In Sending Officer To Emergency

LORAIN, OHIO - Two Lorain police dispatchers were disciplined about a month ago, Chief Cel Rivera confirmed Tuesday.

One of the dispatchers allegedly waited too long to dispatch a squad car to an emergency, Rivera said. The issue came to his attention by an off-duty police officer who eventually responded to the scene of the complaint, he said.

The other dispatcher was written up for calling off sick without having enough sick time, he said.

Both employees were suspended for one day. No additional information was available Tuesday night.

LORAIN, OHIO A drunken city councilman on the prowl was caught Friday night in a prostitution sting, Lorain police said.

Dennis Flores, D-2nd Ward, was charged with solicitation and DUI at 11:27 p.m., after driving up to a decoy prostitute near the corner of Reid Avenue and 18th Street; he was charged by Lorain and Elyria police, a report said.

The 54-year-old councilman, who defeated Brian Hazelett in November 2007 to win his seat, is chairman of the city’s Finance and Claims Committee and vice-chair of the Police and Fire Committee.

Police said he had condoms in his car and alcohol on his breath. Flores’ car was towed, and he was taken to the city jail.

“He is so sorry for what he did. He’s promised to seek help,” Council President Anne Molnar said. “He said he knows he did wrong.”

He has a son named Kurt Graupmann who has been a Lorain Police officer since Sept 18, 1998.

Rivera has taken care of Kurt for years, and even said that “I have the FBI in my pocket because of Kurt’s father.” Any officers who have came forward, have been outed by Graupmann Sr., and harassed or criminally charged.

This explains why the FBI is out for the whistle blowers, rather then Rivera and crew.

LORAIN, OHIO - Judging by the IP address submitting this document, with some comments, someone in federal law enforcement is pissed off at Lorain police chief Cel Rivera efforts to toss Officer Jesus Sanchez “in front of the bus…”

The submitter reminds us that Rivera is married, living apart from his wife, “shacked up with a whore.” A previous Bad Cop News post detailed his living arrangements, addresses, etc.

Thanks to some current and former Lorain Ohio police officers and a federal agent for helping “fill in the blanks” by identifying officers mentioned in the affidavit below but not named.

A.) A lieutenant [Lt. Robert Poli (Retired)] was accused of kissing a woman without her concent. The only adverse action taken against the lieutenant was to transfer him from the Detective Bureau.

B.) A Sergeant [Sgt. Chris Pittak] was accused by a married woman of stalking her. No disciplinary action of any kind was taken against him.

C.) Another sergeant [Sgt. Stan Puza] exposed his penis to a woman and asked for oral sex. No disciplinary action was taken against him.

D.) A patrolman [Stanley Marrero] - currently subject of two $15,000,000 lawsuits, busted for on-duty sex here) attempted to kiss a woman without her consent. He was merely reassigned, without any other disciplinary action.

An inquiry by an Ohio Bad Cop News contributor to Lorain city council member Dan Given (dgiven63@yahoo.com) resulted in a reply that pretty much confirms that lunatics are in fact running the asylum. Given’s less than civil response leaves us wondering how deeply he is involved in the mess which is the Lorain Police Department…

“Dan Given wrote: At least I have the wherewithal to stand up and use my name you spineless ass. Its easy being a no name psychopath isn’t it?”

The sender of the email used his name in the inquiry, so we have no idea what Given is referring to by “use my name” and “no name.” - Obviously Councilman Dan Given has some very serious mental issues which should have been addressed before he sought public office. There would be no sorrow here if someone were to attend a council meeting or go to his home and kick his ass.

Anyway, on to the letter/analysis we received: (with a special BCN “Fuck You!” to Dan Given and Cel Rivera, the latter of whom caused BCN to be blocked from Lorain city and county computers…)

SUBJECT: A PSYCHOLOGICAL AND COMPARATIVE ANALYSIS OF CHIEF RIVERA AND THE ROMAN DICTATOR CALIGULA IN LORAIN POLICE, OHIO

Today, I was thinking about Stanley, and Emilio, and how Rivera’s been crucifying them. How could Ray Farley get special treatment for breaking down the door of a male friend of Ray’s girlfriend and threatening him? Farley has had inappropriate relationships with teenage girls at Southview and spends most of his time hitting on teenage girls at BP. I thought about Kenneth Zapolski and Tabitha Angello wo had sex on duty. Lt. Jame McCann got caught calling offf sick in Lorain so he could work for Amherst and get away from Lorain and said “I’m unhappy with Rivera’s leadership and how he dictates authority to his litle munchkin, Captain Cambarare aka “Little Hitler”. This Captain had a sexual relationship with a 14 year old girl named Amy Saunders in 1986. He cuffed, tortured, terrorized, and played Russian roulette with juveniles under Rivera’s orders in the early 90’s. Corey Earl stole a car, made threats, and sells drugs.

A few weeks ago I watched a special on the History Channel emcompassing notorious dictators like Stalin, Hitler, and the Romand Dictator Galius who was also called Caligula. All of them suffered from mental illness like Chief Rivera, but not as badly as his malady. This made me think that I would like to do a saga or miniseries comprised of three parts, much like that movie National Treasure. The first being this, the next a surprise, and last a synopsis of Rivera’s past and how he has destroyed LPD over the years. I will talk about his Roman house boy’s Rick Resendez and Jim Rohner who were compared to the House Boys in Spartacus. Well, we all know what the house boys did to Spartacus’s under his toga!!! I mean, Cel’s toga!! Remember, Rick is “NO” novice at being a low budget male courtesan. His experiences go back to the 1980’s when a male john heard a little peep when he honked him. Here is part one of the comparative analysis of Cheif Rivera and the Roman dictator Caligula.

When Galius was 7 years old, his father passed away. Rivera’s mother died of meningitis when he was five years old. Galius’s mom was unable to care for him and his siblings so they where sent to various households. Rivera’s father was an alcoholic who could not take care of his eight children, so they were sent to Parma dale Orphanage which was better known as the 6753 State Penitentiary. During these years of chaos, Galius learned to survive. Galius learned to lie, manipulate, and deceive others. Rivera lied on others, so he could go to the Euclid Bearch Park and avoid the wrath of Sister Myra. Galius earned nickname “little boot” which meant Caligula for wearing booots that were large. Rivera earned the nickname “Porky” for always clearing his plate of rice and bread pudding at the orphanage table and making sounds like “Hee Hee.”

Caligula fled to the island of Capri to get away from his dysfunctional surroundings. Rivera fled to Chicago at age 12 to get away from a drunken landlord who liked to play with a loaded gun. As Caligula approached adulthood, he experienced premature balding like Rivera, and had to comb over his hair to give him a fuller appearance. Rivera never got a criminal record as a juvenile, but his subordinate Bob Stack got one for multiple burglaries, along with Pete Catalano for drugs.

To further enhance his career, Caligula covered for his subordinates to gain their allegiance, unlike what [Rivera] is doing to Stanley and Emilio. Rivera took care of Jay Smith when he barricaded himself in a house, threatened to kill his wife, and any officer who may come in. Cel, interceded for Lt. Willie Castro, when he raped a woman after driving her home from a bar. Castro uttered the words while going to 4D “Things will become different when I become chief” to Sgt. Kienzle. Chris Pittak, was taken care of, when he was caught stalking a woman in North Ridgeville, with department issued night vision goggles.

As Caligula grew so did his thirst for power and the longing to do anything to gain that right. Rivera got on Malinovsky’s good side, by saying that Ptlmn. Horvath had made death threats towards him, when in all actuality they were embellished. In 1988, Rivera met with Geno Taliano, Mike Schrull, and Wayne Long, to get Wayne to lie against Chief Malinovsky, but Wayne refused to do their bidding. In 1994, Malinovsky retired, and Craig Casteel was appointed chief. Because Rivera could not handle the thought of Craig being his boss, he filed a lawsuit to contest his civil service exam which Rivera had failed. Like caligula, Rivera conspired with other officers and the Auditor Craig Foltin, to withhold monies for outfitting new cruisers and instigated a vote of no confidence against Craig from the FOP. Rivera’s treachery paid off, when Craig had a nervous breakdown, and stepped down giving Rivera his position.

When Caligula assumed power, Rome never had it so good. Caligula awarded his top conspirators. Like Caligula, Rivera created an inner circle which comprised of Larry Giese, Jim Rohner, Albert Rivera, Jim Ryan, and John Reiber, who were similar to Caligula’s inner circle known as the Praetorian Prefect. All officers were given plum assignments and unlimited overtime. Caligula had a primary supporter named Macro who carried out his bidding. Rick Resendez, was compared to a Roman House Boy in Spartacus and known for being “a butt kissing space cadet who called his wife tarantula face, and was once honked by a male John who became thoroughly disappointed, when all he heard was a peep.” Rick did Rivera’s bidding by going to various active and retired officers on Sheriff’s time, and made them promise not to talk to Plain Dealer reporters doing an expose on police corruption in the Lorian Police Department. He even cajoled, intimidated, and drove Linda Gerek to trial, just so she could testify against Timothy Gerek Jr.

In the first few years, Caligula removed all memories of the old dictator Tiberious, and even made it a crime to utter his name. Rivera did the same things. He remodeled Malinovsky’s office, changed the forms and phone numbers, and even went as far as changing the look of all police vehicles and the uniforms that Malinovsky had designed during his tenure. One time, at a meeting, Jim Smith who had came in under Malinovsky’s tenure, had mentioned the “M” word and was ejected from the meeting, and told never to mention his name. Rivera also set out to remove or fire anyone who may have loyalties to the old chief, such as Wayne Long, Tom Cantu, Jay Smith, Ron Bomback, Timothy Gerek Sr., Timothy Gerek Jr., Shelly Gerek, Ray Sanziano Jr., Jeffrey Cassleman Jr., and Robert Poli.

Over the years, Caligula had several wives, and used his position to bed many of subordinates’ wives. Like Caligula, Rivera was married twice, divorced once, and is presently cohabitating with Elba, who is not his actual wife like Gladys. Rivera, over the years, had officers who had marital problems that confided in him, about their problems, and Rivera capitalized on their suffering, and used his position to call these women up, console them, bed them, and brag about his exploits like Caligula did. Examples were Cindy Schrull, Marty McBennet, And Paula Cantu.

During Caligula’s reign, he would charge people with crimes, watch them go through the whole judicial process and incarcerate them, just for the pure joy of watching them suffer. Rivera did similar things to Wayne Long, Timothy Gerek Jr., and presently, Stanley Marrero, and Emilio Morales just for the shear sake of speaking out against him, and has even made overtures towards their wives. Rivera even ordered officers like Tom Cantu, Pete Rewak, Corey Earl, and Nelson Aponte to torture and terrorize young juveniles in their custody just for the pure sport of watching them suffer.

Suspended Lorain Ohio Police Officers Now Suspended Without Pay By Incoming Safety Director (Police Chief Cel Rivera’s Puppet) Phil Dore

LORAIN, OHIO — Two Lorain police officers facing criminal charges were suspended without pay Wednesday.

Officers Stanley Marrero and Jesus Sanchez both had been suspended with pay since last year, when they were indicted on unrelated charges.

Lorain Safety Director Phil Dore said he believed it was in the best interest of the city to place the two officers on unpaid leave while they’re awaiting trial. He said he did not know why the two officers weren’t suspended without pay when the indictments against them were handed down.

“We inherited this situation from the previous administration,” he said. “Why they didn’t place them on unpaid administration leave — I can’t speak to that.”

Marrero is charged with theft in office, menacing by stalking, intimidation of a witness, public indecency and dereliction of duty. He is accused of having sex with women while on duty and for failing to separate two women who were fighting over him.

Lorain Ohio Corrections Officer Mario Berdiel Busted With Heroin In Drug Sting And Fired

LORAIN, OHIO — A newly hired city corrections officer spent the weekend behind bars after he was arrested Friday evening with heroin, police said.

Mario Berdiel, 56, of Lorain, was charged with possession of heroin and drug paraphernalia by officers of the Lorain Narcotics Unit after he was seen leaving a suspected drug house that was under surveillance, Safety Director Phil Dore said.

Berdiel appeared Monday in Lorain Municipal Court on the drug charges as well as two traffic violations that resulted from the arrest. He pleaded not guilty to the charges and was released after posting a $7,500 cash or surety bond. A preliminary hearing is set for 1 p.m. May 8.

Shortly before 9 p.m. Friday, a narcotics unit was watching a suspected drug house in the 1300 block of Brownell Avenue when officers saw a man walk from the home, get into a vehicle and speed away down Oberlin Avenue.

LORAIN, OHIO - A Lorain police officer who was under the influence of alcohol while on duty in March was suspended Monday for 33 days without pay, city officials said.

Patrolman Jack Brown will begin serving the suspension April 28 and will not be reassigned to patrol duty until he submits documentation that he successfully completed an intensive outpatient program for alcohol abuse, according to his suspension letter.

The letter said that on March 31, a civilian called the Lorain Police Department after Brown appeared under the influence of alcohol when he responded to her apartment complex to investigate a situation regarding tenants.

Brown, an 18-year-veteran, was directed to return to police headquarters and ordered to submit two separate breath tests, and he registered a 0.05 blood alcohol content on both, the letter said.

LORAIN, OHIO — Lorain City Council members met with police Chief Cel Rivera behind closed doors last night. Afterward, Mayor Anthony Krasienko said council members seemed generally satisfied with what they heard.

[What The Morning Journal didn't print is that at least 10 Lorain Ohio police officers have pleaded with City Council members to do something about Rivera, passing along information on "criminal activity by various Lorain police officers, including those in the upper echelon. " They have asked for a independent Department Of Justice Investigation, so they can come forward without fear of retaliation by Rivera and ranking officials in the Lorain Police Department. Lorain residents are urged to contact City Council members (list below with home phone numbers) with the hopes that they'll eventually remove their heads from the sand and do their jobs.]

Krasienko said he couldn’t reveal what was discussed, but said, ”I would think the general consensus of council is they are satisfied with what the chief is doing and the direction he’s taking the department.”

When asked about the atmosphere in the room during the estimated 90-minute meeting, Krasienko said, ”It probably made the whole round. … It was a good debate and discussion.”

He later added, ”I think everybody has a better understanding of what we’re doing as an administration and what the police department is doing as a department.”

The meeting came two weeks after Councilman Dan Given, D at large, called for the chief to come before council to talk about problems with some of the police officers. Several officers have been disciplined for improper behaviors in recent months. Rivera initially expressed surprise about Given’s remarks, explaining that he had talked to Given about his improvement plans during Given’s short time as safety-service director earlier this year.

”There was a lot of information, and the police chief has promised to give me more,” Given said after the meeting. He added he will probably have additional conversations with Rivera once he gets that information.

He added, ”Overall, what I heard definitely cleared up a lot of my questions, and I think the chief is putting forth a plan to move in the right direction.”

Previously, several council members expressed their disappointment in the way Given approached the subject.

During last night’s City Council meeting, resident Denise Caruloff stood in front of City Hall holding a sign stating, ”We Want Answers From Our Chief.” She showed the sign to motorists as they drove by on West Erie Avenue.

LORAIN, OHIO - Lorain City Councilman Daniel Given has taken flak from some of his col leagues for a perfectly reasonable request: He wants Police Chief Cel Rivera to explain to council how he intends to repair the city’s dysfunctional police force.

The accusations that Given risks undermining public faith in the police force are misplaced. Over the last few years, members of that force have done all the undermining necessary.

Rivera has punished city officers for harassing women, making threats and dumping guns in a sewer. Two officers have been indicted for sex crimes. The city has paid out more than half a million dollars in legal claims. Its insurers must be cringing.

Civilians sometimes have a hard time telling the good guys from the bad guys. Nor is it easy to see who is in control - Rivera or the rogue cops who cast suspicion on the entire department.

Former Lorain Ohio Safety Service Director Craig Miller Released Early From Probation

LORAIN, OHIO - Former Lorain Safety-Service Director Craig Miller has been released from probation early.

County Common Pleas Judge Christopher Rothgery, who sentenced Miller to 10 days in jail and three years of probation in October 2006, ended Miller’s probation Tuesday at the request of his probation officer.

Miller, who was convicted of obstruction of justice for lying to police investigating the city’s rental of heavy equipment in 2002 and 2003, had no problems while he was on probation, according to the request to end his probation.

Miller resigned after his conviction, but has never admitted guilt in the case insisting that he made a mistake when he told police the contracts — which led to the conviction of two other people — were legal.

The 9th District Court of Appeals upheld Miller’s conviction earlier this year, but he has appealed that decision to the Ohio Supreme Court.

Lorain Ohio Police Chief Cel Rivera Faces Heat As Public Loses Faith In His Ability To Lead Department

LORAIN, OHIO — The public is losing faith in the Lorain Police Department said Councilman Dan Given, who is calling for Chief Cel Rivera to come before council and explain what’s going on with all problems with some officers.

”The police chief needs to address, in the public, that the public’s losing faith,” Given, D-at-large, said. ”The public’s asking myself and other members of council questions every time we’re out, ‘What’s going on with the police department?’ Every day, there’s a new accusation.”

Several police officers have been accused of wrongdoing, he explained. He added that it might be time for a change in the department.

Two women have filed federal lawsuits against Lorain patrolman Stanley Marrero regarding sexual complaints, and an investigation revealed officer Emilio Morales dumped guns in a city sewer.

Officer Corey Earl has also been in the news several times for various things.

Veteran Lorain Ohio Police Officer Emilio Morales Suspended For 48 Days After Dumping Handguns In City Sewer And Other Infractions

LORAIN, OH — A Lorain police officer who dumped two guns into a city sewer was suspended Monday for 48 days without pay.

Emilio Morales’ suspension was the result of multiple infractions over the course of six months, according to his suspension letter.

The suspension for the 16-year officer included 30 days for dumping the guns and failing to notify the department about them, and 18 days for three other violations of department policy.

The suspension was handed down by Safety Director Phil Dore, who — in accordance with city policy — is the only one that can suspend a police officer for more than three days. Police Chief Cel Rivera recommended the lengthy suspension, but could not enact it without Dore’s approval.

Morales had told Rivera he was given the guns by a female friend who did not want the weapons in her home. The woman told police she received them from her sister, who was having domestic problems with her husband.

Lorain Ohio Police Chief Cel Rivera Claims It Is Hard To Punish Bad Cops, Claims “System” Is Corrupt

LORAIN, OH — After a call-out by a councilman, Lorain Police Chief Cel Rivera said he’ll be glad to meet with City Council about alleged police misbehavior.

But in an extended interview Wednesday, Rivera admitted that he’s as frustrated as City Council because his hands are tied when it comes to disciplining officers.

He said he has wanted to fire officers, but nearly every time he’s tried, an arbitrator has overruled him and allowed the officer to remain on the force.

That’s a product of the system, he said. Arbitrators must be chosen by agreement of the department and the police union, and a selection generally isn’t made until after a lot of back and forth that nearly always results in a compromised decision, he said.

“It’s a corrupt system,” he said. “You’re always going to split the baby, and there’s nothing we can do about it.”

Continued Misconduct In Lorian Ohio Police Department

LORAIN, OH - In the 19 months since The Plain Dealer reported widespread misconduct in the Lorain Police Department, numerous officers have been disciplined again. Here are some of the latest troubles:

Officers had to separate two women fighting over Capt. William Engle at his home in October 2006. Engle brought a woman home while his girlfriend slept. He was too drunk to talk to officers, according to police reports.

Patrolman Jack Brown was arrested on a domestic-violence charge after a fight with his ex-wife at an Amherst Township home in November 2006. She accused him of being intoxicated. The charge was reduced to disorderly conduct. He received probation. Brown was placed on administrative duty last week while the department investigates separate allegations that Brown smelled of alcohol while handling a call.

Officers Shawn Petty and Timothy Thompson and Sgt. James Wolford were reprimanded in January for not following procedures at a bar fight last summer.

City Councilman Orders Lorain Ohio Police Chief Cel Rivera To Appear And Explain Why So Many Of His Officers Are In Trouble - Time For Rivera To Get His Act Together Or Hit The Road

LORIAN, OH - The Lorain police chief and commanding officers need to straighten out the department or the city needs to bring in new leadership to restore honor, a councilman says.

Councilman Dan Given has ordered Chief Cel Rivera to appear before City Council on April 28 to explain publicly why so many officers have been in trouble lately. Rivera needs to explain how he plans to straighten out the department before crime spikes as warm weather approaches, Given said.

The citizens have lost confidence and trust in the force, Given said.

“There is some kind of new claim against the department every week,” Given said. “The public is not behind them.”

Since October 2006, at least 10 officers have been punished for inappropriate behavior, including stalking women, threatening people and dumping guns in a sewer. Two officers have been indicted for sex crimes. And the police union president spent a week in jail for violating a civil protection order.
