LEBANON, TENNESSEE — A former state trooper accused of overlooking a possible drug charge in exchange for a sexual favor was sentenced to four years of probation under a deal reached in court Thursday.

James “Randy” Moss will serve no jail time under the terms of his plea. If he completes his probation with no problems, he will be able to have the case dismissed and his criminal record expunged, his attorney said.
Moss became the subject of a state investigation last summer after a Wilson County traffic stop involving Knoxville resident Justis Ellen Richert, who performs in adult films using the name Barbie Cummings. He stopped Richert for speeding and reportedly found illegal pills in her pink Honda. He was accused of throwing the pills away after Richert performed a sex act on him.

NASHVILLE, TENNESSEE - A Wilson County grand jury indicted a Tennessee Highway Patrol trooper who left the department earlier this year after allegedly engaging in a sex act with a motorist.

Moss now faces charges in connection with that stop and another one involving a second woman.
Moss turned himself in to the Wilson County Jail after a grand jury handed up a 10-count indictment against him.
The Tennessee Bureau of Investigation found enough evidence to charge Moss in two separate incidents.
“I’m certainly not agreeing that what he did was a criminal offense, but he recognizes that he made an error in judgment,” said Jack Lowery, the former trooper’s attorney.

Agents arrested James “Randy” Moss on Tuesday after a grand jury indicted him on 10 charges, including tampering with evidence, official misconduct and official oppression.
Moss, who resigned from the Tennessee Highway Patrol in May, was released on $2,500 bond. His attorney, Jack Lowery Sr., said he plans “to enter a plea of not guilty to all the counts.”
Porn actress Justis Richert wrote on her blog under film name “Barbie Cummings” that Moss took photos and video of their encounter in May and sent copies to her.

NASHVILLE, TENNESSEE – When Tennessee Highway Patrol troopers are fired or leave under a cloud, the agency has neglected to notify the state board that oversees police officers’ conduct — making it possible for troopers in trouble to go to work as cops with other departments.
The patrol should have notified the state Peace Officers Standards and Training Commission about 44 troopers who left in the previous year, patrol commander Col. Mike Walker said. Most of those troopers retired or left on good terms, but 13 in the group were either fired or left under scrutiny, records show.
The patrol informed the oversight board late last month about the ex-troopers after The Tennessean inquired about a former lieutenant from Chattanooga who records show was allowed to resign after being accused of “gross misconduct.” That trooper has subsequently gone to work as a sheriff’s deputy in Franklin County.

Prosecution could have voluntarily dismissed the cases without a judge being involved. Prosecutors have not yet filed criminal charges against the ex-cop, who is reportedly facing 15 years of rape in prison.

“A lot of these women live out of state,” he said. “Some of it may be unfounded. But we’re taking it beyond this initial traffic stop.”
The questions surfaced after investigators began reviewing video recordings from Moss’ in-car camera, Thompson said. Moss appeared to turn off the camera on some stops, he said, or walked out of view behind his cruiser with the women.

NASHVILLE, TENNESSEE – One female trucker says state trooper Sgt. Leon King ordered her into a secluded room at an Interstate 40 weigh station in January 2006 and propositioned her.
Another says King caressed her hands, arm and buttocks at that Weststate weigh station.
King stayed on the job four months during the first investigation. Days after the second incident, the patrol let him retire with his full pension. No investigation was done.
The handling of the complaints about King, and two other cases involving troopers and women, raise questions about whether agency reforms in 2006 took root.
Officials responding to the complaints were the ones put in place after Gov. Phil Bredesen pledged to end the patrol’s history of cronyism and tolerating troopers’ misconduct.

NASHVILLE, TENNESSEE — A state trooper in line to be fired now will be allowed to resign after a Knoxville porn actress wrote in her blog about performing oral sex on him during a traffic stop.
The Tennessee Highway Patrol announced last week it sent James Randy Moss, 40, a letter of termination giving him the option of a hearing before he is officially dismissed.
Earlier in the day, Moss had sent in a letter of resignation, but officials said they didn’t know about the letter until after they had notified him of the termination, patrol spokesman Mike Browning told the Knoxville News Sentinel on Tuesday.
“The Department of Safety is going to honor his resignation in lieu of termination,” Browning said.
Moss declined comment and referred a reporter to his attorney, Jack Lowery Sr. of Lebanon.

Cummings, whose real name is Justis Ellen Richert, lives in Knoxville and blogs about her work and personal life. An entry on her blog describes the traffic stop and oral sex with a state trooper.

NASHVILLE, TENNESSEE ? The troubles keep coming for the Tennessee Highway Patrol.
A state trooper accidentally shot one of his fellow troopers in the foot Monday while cleaning his gun at the THP Training Center, authorities said, making for a trifecta of troopers recently suspended and under investigation.
Trooper John Warren was placed on administrative leave pending an investigation by the Department of Safety’s Office of Professional Responsibility, THP spokesman Mike Browning told The Tennessean.
Officials said Warren, a trooper since 1996, shot Trooper Tracy Tyler while cleaning his gun. Tyler was treated at Vanderbilt University Medical Center.
Warren joins the ranks of Trooper Terry Rainey, accused of shooting his mother in the foot during an argument Saturday night in Madison County in West Tennessee, and Trooper James Randy Moss, suspended after Knoxville-based porn actress and blogger Barbie Cummings wrote about giving him oral sex during a traffic stop May 7 near Lebanon in Middle Tennessee.

NASHVILLE, TENNESSEE - A porn star claims a state trooper who stopped her on a highway let drug
charges slide in exchange for oral sex. And she says she’s got proof _ the trooper’s own video images of the roadside tryst. The allegations have led to a Tennessee Highway Patrol investigation and the trooper’s suspension.
The trooper, James Randy Moss, declined to comment Tuesday. Highway Patrol spokesman Mike Browning confirmed investigators have interviewed the porn star, who is identified on a citation by her real name, Justis Richert.
Richert, 21, who lives in Knoxville, did not immediately respond Tuesday to messages left on her cell phone or e-mail requests for an interview.
But on her blog, written under the screen name “Barbie Cummings,” she goes into explicit detail about the encounter. She says she has photos and video footage of the encounter sent to her by the trooper, as well as a speeding ticket, to back up her story.

KNOXVILLE, TENNESSEE ? A Tennessee Highway Patrol officer has been suspended after a woman claims she got out of a possible drug arrest because she had a sexual encounter with the officer.
There are allegations that the trooper, Randy Moss, while on duty, pulled over a Knoxville woman, who works in the porn industry.
He found out she had drugs in her car, disposed of the drugs, engaged in a sexual act with her, and then let her go.
The incident started as a routine traffic stop in Wilson County, at the intersection of Highway 840 and Interstate 40 in the early morning hours of May 7.
The woman, who calls herself Barbie Cummings, wrote in her online blog that she had been drinking and had liquor and drugs in her car.
